Terms of Service

These terms govern the use of PreShot, operated by Blinds Creative V.O.F.. By creating an account or subscribing you agree to them.

1. The service

Blinds Creative V.O.F. (“we”, “us”) operates PreShot, a subscription service: shot lists, storyboards, shooting schedules, call sheets and budgets, synced to a workspace.

  • Standard is a single-seat subscription for one person.
  • Pro is a multi-seat subscription that additionally includes the crew address book and, as they ship, tools for sending call sheets to a crew and collecting their confirmations.

Both are the same application and the same five modules; they differ in how many people may edit and which collaboration features are enabled. Where these terms say “the service” without naming a plan, they apply to both.

2. Accounts

An account is created with an email address and password. You are responsible for keeping your password confidential and for activity that happens under your account. Tell us at support@preshotapp.com if you believe an account has been accessed without your permission.

The service is intended for use by production companies and the people who work with them — producers, directors of photography, assistant directors, and the crew and collaborators they invite. You must be able to form a binding contract to create an account.

3. The free trial

A new PreShot account starts a 14-day trial with 2 seats, and no payment card is requested to start one. The trial ends on its date with no grace period: on that day the workspace becomes read-only. Nothing already in it is deleted, and printing and export continue to work. Subscribing restores editing immediately. We reserve the right to limit trials to one per organisation or person to prevent abuse.

4. The PreShot subscription

PreShot is billed per seat, monthly or annually, at the prices shown on preshotapp.com/pricing. Prices are shown excluding VAT; VAT is calculated and added at checkout by Paddle, our payment provider, based on your location and, where you supply one, your VAT number.

A seat is consumed by anyone who can edit a document in your workspace — add a shot, move a schedule strip, change a call sheet. People who can only view and print a shared production do not consume a seat, whether or not they are members of your workspace.

Subscriptions renew automatically for the same period until cancelled. You can cancel at any time; cancelling takes effect at the end of the period you have already paid for, and the workspace becomes read-only from that point rather than immediately. 5. Plans, seats and changing between them

A seat is one named person, on as many of their own devices as they like. Standard includes one seat. Pro includes 2 and additional seats may be added at 10 per seat per month (excluding VAT). People given read-only access to a production do not occupy a seat and are not charged for.

You may change your seat count at any time. Increases take effect immediately and are charged pro rata by Paddle; decreases take effect at the same time and are credited pro rata. A decrease that would leave fewer seats than there are people occupying them is refused until those people are removed from the workspace.

Reducing to a single seat moves the subscription to Standard, which disables the Profeatures. Data created while on Pro is not deleted: it remains readable, exportable and deletable. In particular, the crew address book stays fully readable and erasable regardless of plan, so that you can continue to meet your own obligations to the people recorded in it.

The licence is checked periodically over the internet. After 30 consecutive days with no successful check the application becomes read-only until it can check again. Data already in the application is never deleted by this, and printing and export continue to work while read-only.

6. Cancellation and refunds

Paddle, as merchant of record, handles the sale and processes refunds on our behalf. What follows is when we authorise one.

Subscriptions on either plan can be cancelled at any time from your account. Cancelling stops future billing; we do not refund the portion of a period already paid for. When a subscription lapses — through cancellation or a failed payment — the workspace becomes read-only. Nothing is deleted: every shot list, schedule and call sheet still opens, still prints and still exports, and resubscribing restores editing immediately.

A first subscription payment can be refunded within 14 days if the service has not been used beyond reasonable evaluation. Requests after that window, or after substantial use, are considered individually. The 14-day trial takes no payment, so there is normally nothing to refund before it.

To request a refund, contact support@preshotapp.com with your order details. This section describes when we authorise a refund; it does not limit any statutory right you may separately have.

7. Acceptable use

You agree not to use the service to:

  • break any applicable law, or infringe anyone else’s rights;
  • attempt to access another workspace’s data, or circumvent the seat or licence checks described above;
  • upload material you do not have the right to store or share;
  • interfere with the operation of the service or attempt to extract its source code beyond what applicable law permits.

We may suspend or terminate an account that breaches this section, after giving notice where reasonably possible.

8. Your content, and ours

Your productions — shot lists, storyboards, schedules, call sheets and budgets — belong to you. We claim no ownership over them and use them only to provide the service to you, as described in the privacy policy.

The software, its design and the PreShot name and marks belong to Blinds Creative V.O.F.. Buying a licence or a subscription gives you the right to use the software as described here; it does not transfer ownership of it.

9. Availability and changes

We aim to keep PreShot available and to give notice of planned downtime, but we do not guarantee uninterrupted access. We may change or discontinue features of the service; where a change materially reduces what a paid plan includes, we will give reasonable notice. The application is designed to keep working offline within the licence-check window described in Section 5 regardless of service availability.

10. Liability

Nothing in these terms excludes liability that cannot be excluded under Dutch law, including liability for intent or gross negligence.

Subject to that, our total liability to you arising from these terms or the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim, and we are not liable for indirect or consequential loss, including lost profit, lost data beyond what a reasonable backup would have preserved, or business interruption.

A complete copy of your work is kept both on your own machine and in your workspace — see the privacy policy and Your data. Keeping backups of your own work nevertheless remains your responsibility, and this section applies in full to any loss that a backup would have prevented.

11. Governing law

These terms are governed by the laws of the Netherlands. Disputes that are not resolved informally will be brought before the competent court in the district where Blinds Creative V.O.F. is registered, without prejudice to any mandatory consumer-protection rule that gives you the right to bring a claim elsewhere.

12. Changes to these terms

We may update these terms from time to time. We will change the date at the top of this page when we do, and for changes that materially reduce your rights we will make reasonable efforts to notify active customers directly before the change takes effect.
